Version dated 19 September 2026 – effective from: 19 September 2026

Article 1 – Purpose and publisher

These general terms of use and services, hereinafter the “Terms”, govern access to the website www.experts-du-patrimoine.fr, its use, the creation and management of accounts, the publication of professional profiles, contact with visitors and subscriptions to the Starter, Pro and Premium plans.

The Website is published by SAND 360, whose registered office is at 91 rue du Faubourg Saint-Honoré, 75008 Paris. Full legal information about the publisher, including its legal form, capital, registration, VAT number and the hosting provider's contact details, is set out in the Website's legal notice.

Les Experts du Patrimoine is a directory and contact service. Through the Website, SAND 360 does not provide investment, legal, tax, property or wealth advice and is not a party to relationships established between a visitor and a listed professional.

Article 2 – Definitions and scope

“Visitor” means anyone browsing the Website. “Professional” means the natural or legal person listed or applying to be listed. “Account Holder” means the person creating or administering an account for themselves or on behalf of a Professional. “Profile” means the public page devoted to a company or professional. “Subscription” means a paid Pro or Premium plan. “Content” means any text, image, logo, document, link, event or information supplied or published by a user.

Paid services are offered to professionals acting for business purposes. The Account Holder declares that they have the necessary authority to bind the Professional they represent.

Article 3 – Acceptance, enforceability and evidence

Browsing public pages requires compliance with the Website's usage rules, which are accessible at all times. Creating an account or taking out a Subscription requires express acceptance of the Terms through a dedicated checkbox that is not pre-ticked.

The accepted version, its date, the account identifier and the essential order details may be retained as evidence of acceptance and the transaction. The Account Holder may download or request a copy of the version applicable to their subscription.

Article 4 – Website access and account creation

Professional accounts are reserved for those working in management, advisory services, law, finance, insurance, property, accounting or wealth services, subject to SAND 360 accepting their listing.

The Account Holder supplies accurate, complete and current information. They protect their credentials, use a strong password and promptly inform SAND 360 of any unauthorised access. Actions taken through the account are deemed to have been taken by its Account Holder, unless there is evidence of fraudulent access for which they are not responsible.

Depending on the plan chosen, one account may manage several Profiles. The Account Holder remains responsible for permissions granted to collaborators and must revoke them when those collaborators are no longer authorised.

Article 5 – Listing, claiming and verifying Profiles

Profiles may be created at a Professional's request or from publicly available professional information, including institutional websites, official registers or the Professional's website. Where personal data was not collected directly from the person concerned, that person is informed in accordance with applicable regulations, unless a documented statutory exception applies.

A Professional may request to claim, correct, complete or, where applicable law permits, delete or delist a Profile. SAND 360 may request any reasonable evidence to verify identity, authority, the organisation's existence, its SIREN number or professional authorisations.

Checks carried out by SAND 360 are documentary consistency checks at a given date. They are neither certification, authorisation nor an ongoing guarantee of competence, solvency, good repute or regulatory compliance. Each Professional remains responsible for keeping their information and authorisations current.

Article 6 – Starter, Pro and Premium plans

The active features are those presented on the plans page and in the summary displayed at subscription. At the date of this draft, the plans are structured as follows:

Feature Starter Pro Premium
Price Free Paid Paid
Maximum number of Profiles 1 3 10
Directory listing Yes Yes Yes
Public contact details No Yes Yes
Event publication No Yes Yes
Access to contact enquiries No Yes, with no contractual quota Yes, with no contractual quota
Multilingual version No No Depending on the languages offered
Partner discounts No No Yes, subject to availability
Display priority Standard After Premium profiles Highest priority

“No contractual quota” means that SAND 360 sets no maximum number of enquiries received; it does not guarantee the volume, quality or conversion of contacts. Partner, multilingual and third-party-dependent features remain subject to technical and commercial availability.

Limits apply to all Profiles linked to the account or the same subscription. If a plan change causes the limit to be exceeded, the Account Holder chooses which Profiles to keep active; otherwise, SAND 360 may move excess Profiles to draft after prior notice.

Article 7 – Ranking, promotion and no guarantee of results

The plan level may affect display order: Premium Profiles appear before Pro Profiles, which may themselves appear before Starter Profiles. Within a level, order may depend on the subscription or renewal date, completeness, relevance, location, recent activity, or quality and abuse-prevention criteria.

SAND 360 may change ranking criteria to improve the service, provided it does not remove the substance of a paid feature during an ongoing period without legitimate grounds. No fixed position, lasting first-page placement, organic search performance, audience, number of contacts, revenue or return on investment is guaranteed.

Article 8 – Subscription, prices, taxes and payment

Before confirmation, the Account Holder is informed of the price excluding tax, applicable VAT, total including tax, billing interval, initial term and main features of the chosen plan. The applicable price is that displayed in the order summary at subscription.

Payment and payment-method management are handled by the payment provider identified at checkout, currently Stripe. SAND 360 does not retain full payment-card details. The Account Holder authorises recurring charges for the chosen Subscription.

Any amount not paid when due by a business customer automatically bears interest, without reminder, at the rate provided for in Article L. 441-10 of the French Commercial Code and gives rise to the statutory fixed recovery-cost compensation of 40 euros, without prejudice to justified additional compensation where the costs incurred are higher.

Article 9 – Term, renewal, plan changes and cancellation

The Subscription is taken out on the monthly or annual basis stated at checkout. It renews automatically for successive periods of the same length unless cancelled before the next renewal date through the subscription area or payment portal.

Cancellation takes effect at the end of the period already paid for. Unless mandatory law provides otherwise, amounts for a period already started and properly supplied are not refunded. The Account Holder retains access to paid features until cancellation takes effect, subject to full payment and compliance with the Terms.

A plan change may result in a prorated charge, credit or immediate billing. Its effect and amount are displayed before confirmation. When switching to a plan with a lower limit, the rules on excess Profiles in Article 6 apply.

If payment fails, SAND 360 may retry the payment, ask the Account Holder to update their payment method and then, after giving notice, suspend paid features or switch the account to Starter.

Article 10 – Promotional or complimentary plans

SAND 360 may grant a Pro or Premium plan free of charge, temporarily or indefinitely. Unless stated otherwise, such a grant creates no right to a refund, compensation or permanent continuation. It may be withdrawn prospectively on reasonable notice, except in cases of fraud, abuse, security incidents or serious breaches warranting immediate withdrawal.

A free plan becomes paid only after clear price information and the Account Holder's express agreement; no automatic paid conversion may occur without a valid payment method and agreement.

Article 11 – Obligations concerning Content and professional activities

The Professional warrants that their Content is accurate, fair, verifiable, current and compliant with the rules governing their activity, particularly regarding promotional communications, authorisations, regulatory disclosures, intellectual property and data protection.

  • They must not impersonate anyone or falsely claim a capacity, title, approval or authorisation.

  • They must not publish unlawful, misleading, defamatory, discriminatory, violent, fraudulent or malicious content, or content infringing third-party rights.

  • They must not present past performance, a rating, a review or a financial product in a way liable to mislead the public.

  • They must not collect, divert, resell or reuse visitors' contact details beyond the purpose of establishing contact without an appropriate legal basis.

The Professional alone is responsible for the services, advice, products, documents and communications they provide to visitors. They obtain and maintain the insurance, registrations and authorisations required for their activity.

Article 12 – Licence for published Content

The Professional retains ownership of their Content. They grant SAND 360 a worldwide, non-exclusive, royalty-free licence for the publication period plus the time required for backups and legal obligations, allowing it to host, reproduce, adapt solely for technical formatting, translate when that feature is enabled, index, display and promote the Profile and Website on any medium.

This licence is strictly limited to operating, securing, indexing and promoting the service. It does not authorise SAND 360 to sell the Content itself or transfer to third parties exploitation rights independent of the Website. The Professional warrants that they hold the necessary rights to the texts, trademarks, logos, photographs and other materials supplied.

Article 13 – Ratings, reviews and third-party data

The Website may display ratings, reviews or information from third-party services or public sources, including Google. Their availability, currency and accuracy depend in particular on the source, the identifier associated with the Profile and the provider's technical conditions.

The Professional may report an incorrect association or clearly inaccurate data. SAND 360 may correct, hide or remove the disputed display during verification. Third-party trademarks and content remain the property of their respective owners.

Article 14 – Email contact and contact requests

The Website may provide a contact button or link using the “mailto:” protocol. Activating it opens the Visitor's email application and allows them to email the Professional directly. The message is sent by the Visitor's chosen email service without passing through a form or SAND 360's servers. SAND 360 does not receive, read or retain the email's content.

SAND 360 has no knowledge of the email's subject, content or attachments and cannot verify whether a message was actually sent or received. The Visitor alone remains responsible for the information they choose to disclose to the Professional.

Subject to applicable consent choices and the Privacy Policy, SAND 360 may record button activation and only the technical data necessary for audience measurement, Profile statistics and Website security. This data does not include message content.

Once sent, communications take place directly between the Visitor and the Professional. The Professional processes the data received under their own responsibility and in accordance with applicable regulations.

SAND 360 guarantees neither a response from the Professional nor the quality of the subsequent relationship. Unless clearly necessary, messages must not contain banking data, passwords, identity documents, health data or other particularly sensitive information.

When a visitor requests access to hidden contact details, SAND 360 may inform the Professional of the date and nature of the attempt. The visitor's IP address and technical security identifiers are not disclosed to the Professional, unless legally required or duly justified as necessary and brought to the attention of the person concerned.

Article 15 – Wealth review tool and simulators

The Website may offer a wealth review tool and simulators providing indicative results based on information entered by the User and general assumptions. These tools are exclusively informational and educational. They constitute neither a comprehensive assessment, a personalised recommendation nor legal, tax, accounting, financial, property or investment advice.

Results depend on the accuracy, completeness and currency of entered data, and on the parameters, assumptions, scales and rules incorporated at the calculation date. They may differ from the User's actual situation and change because of changes in their circumstances, regulations, taxation, markets or calculation methods. The User must verify the data and assumptions used and seek a competent Professional's advice before any decision.

Unless clearly stated otherwise and following an affirmative action by the User, entered information and generated results are not sent to a Professional. Any processing by SAND 360, including to provide the feature, secure the Website, save a session or improve the service, is described in the Privacy Policy, which specifies the data concerned, legal basis, recipients and retention period.

The User must refrain from entering passwords, banking details, full identity documents or other data unnecessary for the calculation. SAND 360 guarantees neither absolute accuracy, completeness nor suitability of results for a particular purpose and cannot be held liable for a decision based solely on them, subject to liabilities that cannot lawfully be excluded.

Article 16 – Participation in the Les Experts du Patrimoine Championship

By registering for and participating in the Les Experts du Patrimoine Championship, the Player agrees that information about their virtual portfolio, including its composition, positions, performance and development, and their professional contact details, may be shared with Championship partners for its organisation, operation, promotion and monitoring.

Recipient partners may use this information only for purposes disclosed to the Player, in compliance with applicable personal data protection regulations. The data concerned, recipient categories, purposes, legal bases and retention periods are specified in the Website's Privacy Policy.

The Player may object to this disclosure at any time without giving reasons by writing to [email protected]. This objection takes effect for future disclosures within a reasonable time of being processed and does not, in itself, affect participation in the Championship.

Article 17 – Moderation, reporting, suspension and deletion

Any potentially unlawful, misleading or rights-infringing content or conduct may be reported to [email protected] , stating the URL concerned, the reasons for the report, relevant evidence and the reporter's contact details.

SAND 360 may request a correction, limit visibility, remove Content or suspend a feature or account, particularly in cases of inaccurate information, impersonation, expired authorisation, non-payment, security breaches, abuse, violation of the Terms or legal requirements.

Except in emergencies, fraud, risks to users, legal obligations or repeated breaches, the Professional is informed of the reason and given a reasonable time to comment or remedy the situation. Measures are proportionate to the seriousness of the matter and may be submitted to SAND 360 for review.

Deleting an account ends access to the private area. It does not necessarily result in immediate deletion of all public professional information where another legal basis permits its retention; data subjects' rights remain fully applicable.

Article 18 – Use of the Website by visitors

The Visitor uses the directory as an identification tool and carries out their own checks before commissioning work, disclosing sensitive information or purchasing a product. A listing, promotion, rating, documentary check or use of “expert” in the brand is neither a personalised recommendation, a guarantee nor certification by SAND 360.

In particular, bulk data extraction, unauthorised scraping, bypassing security measures, automated use disrupting the service, unsolicited messaging, creating a competing database and any reuse infringing the rights of SAND 360 or listed persons are prohibited.

Article 19 – SAND 360's intellectual property

The Website's structure, developments, databases, editorial texts, graphics, visuals, trademarks and logos are protected by the intellectual property rights of SAND 360 or its licensors. No rights are transferred to the user beyond a personal, limited, revocable and non-exclusive right to use the Website under the Terms.

Short quotations permitted by law must name the source and link to the relevant page. Any substantial extraction or reuse of the database is prohibited without written permission.

Article 20 – Personal data, marketing and cookies

SAND 360 processes personal data under its Privacy Policy, which specifies for each processing activity its purposes, legal bases, data categories, recipients, retention periods, any transfers outside the European Economic Area and individuals' rights.

Communications necessary to manage the account and Subscription are based on contract performance or legitimate interests. Marketing communications comply with the rules on business marketing and include a simple opt-out. Separate consent is obtained where legally required.

Non-essential trackers are placed only after a valid choice where regulations require it. Refusal must be as easy as acceptance, and consent may be withdrawn at any time through an accessible module on the Website.

Article 21 – Availability, maintenance and security

SAND 360 uses reasonable efforts to ensure Website availability and security. Access may nevertheless be interrupted for maintenance, updates, incidents, attacks, provider failure, force majeure or security needs.

Continuous availability or complete absence of errors is not guaranteed. Where reasonably possible, maintenance likely to materially affect a paid service is announced in advance. SAND 360 implements appropriate backups, which do not relieve the Professional of keeping copies of important Content.

Article 22 – Liability

Each party is liable for direct and foreseeable damage resulting from its breaches. SAND 360 is not liable for a Professional's acts, advice, products, omissions or statements, decisions based solely on the directory, third-party content or services, or damage caused by improper use of the Website.

In dealings with a business customer, except for gross negligence or wilful misconduct, personal injury, breach of an essential obligation, intellectual property infringement, breach of data protection rules or any other case where limitation is prohibited by law, SAND 360's total liability under a Subscription is limited to the amount excluding tax paid by the customer during the twelve months preceding the event giving rise to liability.

Loss of revenue, customers, opportunities, reputation or data, and indirect losses, are compensable only within the limits permitted by law. No provision of the Terms deprives an essential obligation of SAND 360 of its substance.

Article 23 – Third-party services and links

The Website may integrate or link to third-party services, including payment, appointment-booking, mapping and review tools or Professionals' websites. These services are governed by their own terms. SAND 360 does not control their availability or content and may remove a link that presents a risk or is unlawful.

Article 24 – Changes to the service, plans and Terms

SAND 360 may change the Website and Terms for legal, technical, security or service-improvement reasons. The update date appears at the start of the document.

Purely formal or legally required changes may take effect upon publication. Any materially adverse change affecting an ongoing Subscription is notified on a durable medium a reasonable time before taking effect. Where the change cannot reasonably be deferred and materially alters the paid service, the Account Holder may cancel before it takes effect, with no charges other than amounts due for the period already provided.

A price change applies only to a subsequent renewal period, after advance notice allowing the Account Holder to opt not to renew.

Article 25 – Force majeure

Neither party is liable for a breach caused by an event meeting the legal criteria for force majeure. Affected obligations are suspended for the event's duration. If a permanent or abnormally prolonged impediment makes performance impossible, either party may terminate the affected service under the conditions provided by law.

Article 26 – General provisions

If a provision is held invalid or unenforceable, the remaining provisions remain in force. Failure to exercise a right immediately does not constitute a waiver. Headings aid reading and do not affect interpretation.

The Professional may not assign their account or Subscription without SAND 360's prior written agreement, except for a restructuring involving universal succession or where the law provides otherwise, subject to informing SAND 360.

Article 27 – Complaints, governing law and jurisdiction

The Terms are governed by French law. Any complaint must be sent to [email protected]. The parties endeavour to reach an amicable solution before taking action, without preventing urgent measures or affecting statutory deadlines.

Failing agreement, the dispute falls within the courts competent under ordinary legal rules. BETWEEN SAND 360 AND A CUSTOMER CONTRACTING AS A MERCHANT, PROVIDED THIS CLAUSE HAS BEEN BROUGHT TO THEIR ATTENTION VERY PROMINENTLY, THE COURTS OF PARIS HAVE EXCLUSIVE JURISDICTION. This provision is not enforceable against persons against whom Article 48 of the French Code of Civil Procedure does not permit it to be enforced.

If a service is exceptionally purchased by a person protected by mandatory consumer-law provisions, those provisions remain applicable, particularly regarding information, withdrawal, renewal, cancellation, mediation and jurisdiction.
